1. Acceptance of Terms

By downloading, installing, or using the Neon application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Neon is a personal expense tracking and budget management application. The App allows you to track spending, manage accounts, set budgets, categorize transactions, schedule recurring payments, and view financial statistics. Neon is a tool for personal financial organization and does not provide financial advice.

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update it as necessary. You are solely responsible for all activity that occurs under your account.

All financial data you enter into Neon remains your property. You are responsible for the accuracy of the data you input. Neon does not verify the accuracy of user-entered financial information.

6. AI Features

The App includes AI-powered features for expense logging and financial insights. AI-generated categorizations and suggestions are provided as conveniences and may not always be accurate. You should review and verify all AI-processed entries.

7. Subscriptions and Payments

Neon offers a free tier and a paid subscription ("Neon Pro") that unlocks additional features. Subscriptions are billed through the Apple App Store or Google Play Store. By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may manage or cancel your subscription through your device's account settings (Apple ID or Google Play account). If a subscription includes a free trial period, it will automatically convert to a paid subscription upon expiration unless cancelled beforehand.

Refunds are subject to the policies of the Apple App Store or Google Play Store, as applicable. Neon reserves the right to modify subscription pricing with reasonable notice. Any price changes will apply to the next billing cycle following the notice.

8. Internet Connectivity

Certain features of the App, including but not limited to AI-powered chat, cloud backup, and automatic payment detection, require an active internet connection. Neon does not guarantee full functionality of the App without internet access and is not responsible for any limitations resulting from lack of connectivity.

You are responsible for any mobile data or roaming charges incurred while using the App. If you are not the bill payer for the device on which you use the App, you confirm that you have obtained permission from the bill payer.

The App integrates with third-party services to provide its functionality, including but not limited to:

Neon is not responsible for the availability, accuracy, or performance of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

10. Notification Access (Android)

On Android devices, the App offers an optional automatic payment detection feature that requires access to device notifications. This feature reads notifications from selected financial apps to identify and log transactions. Notification data is processed to extract transaction details and is not shared with third parties beyond what is necessary for AI-powered parsing.

You may enable or disable this feature at any time through the App settings. Granting notification access is entirely voluntary and is not required to use the App.

11. App Updates and Availability

Neon may release updates to improve functionality, fix issues, or comply with legal requirements. System requirements may change with updates, and you may need to download the latest version to continue using the App. Neon does not guarantee that updates will always be available or that the App will remain compatible with your device.

Neon reserves the right to discontinue the App or any of its features at any time without prior notice. Upon discontinuation, your right to use the affected features ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the applicable jurisdiction.

13. Intellectual Property

The App, including its design, code, logos, and content, is the intellectual property of Neon and is protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

14. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Neon does not guarantee that the App will be uninterrupted, error-free, or secure. Neon is not a financial advisor and the App should not be used as a substitute for professional financial advice.

15. Limitation of Liability

To the fullest extent permitted by law, Neon shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to financial losses resulting from reliance on App data or features.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting within the App or on our website. Continued use of the App after changes constitutes acceptance of the revised Terms.

17. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately.
